GoEducate Employer Terms of Use

1. Introduction

Welcome to GoEducate Inc. (“GoEducate,” “we,” “us,” or “our”). These Employer/Organization Terms of Use (“Terms” or “Agreement”) govern your use of the GoEducate platform, including any websites, mobile applications, portals, services, and features controlled or operated by GoEducate (collectively, the “Platform”). These Terms apply to all employer entities, workforce organizations, chambers of commerce, nonprofits, and any other participating organizations (collectively, “Organizations” or “you”) who create an account or otherwise use the Platform for recruiting, apprenticeship promotion, talent sourcing, or related workforce development activities.

By accessing or using the Platform, you represent that you are authorized to accept these Terms on behalf of your Organization and that you have read, understood, and agree to be bound by these Terms and all other referenced documents, including the GoEducate Employer/Organization Privacy Policy and the GoEducate Consumer Privacy Policy.

If you do not agree with these Terms, you must discontinue using the Platform immediately.

1.1 Region-First Focus

GoEducate’s platform and features are centered around a region-first approach, bridging local employers, educational institutions, and talent pipelines. By using the Platform, you acknowledge that certain features or data may be region-specific and not universally available outside of designated service areas.

1.2 New & Growing Platform

GoEducate is continually refining and expanding its ecosystem to meet local market needs. Certain features may be in beta or subject to frequent updates. We appreciate your feedback as we scale, and you understand that some tools or functionalities may evolve, launch in specific regions first, or change based on user input.

2. Eligibility and U.S.-Based Services

The Platform is offered solely to Organizations operating within the United States. By using the Platform, you confirm that:

  • Your Organization is located and operates within the U.S.
  • You will not use the Platform to access, store, or transfer data outside of the United States.
  • You are authorized to bind your Organization to these Terms.

3. Description of Services

GoEducate provides Organizations with tools to:

  • Create a Company Profile and Showcase Opportunities
    (e.g., apprenticeships, internships, full-time roles):
    Display opportunities on a dedicated apprenticeship page, a job board page, and our “Who’s Hiring” page, increasing your exposure to potential candidates.
  • Access the Talent Hub
    Discover candidates matched to your specified skill requirements and preferences by logging into the Platform’s backend credentials provided to you.
  • Utilize Data-Driven Insights
    Leverage metrics, industry trends, and, for certain subscription tiers (e.g., Accelerate+), top-line aggregated GoSurvey results (e.g., name and top results, but no emails) for informed hiring decisions. GoEducate may share these high-level analytics for industry insights without identifying candidate emails.
  • Communicate with Candidates
    Engage with prospects through the Platform’s messaging and outreach tools.
3.1 Regional Coverage Disclaimer

While GoEducate emphasizes local pipelines and is actively expanding coverage, no guarantee is made that your region is fully supported or that labor market data is complete for every locality. Coverage and candidate volume may vary based on local participation and other factors. GoEducate disclaims liability for any lack of region-specific data or mismatches in expected candidate volume.

The availability and scope of features may also vary based on your chosen subscription plan, add-ons, or promotional offers. High-level descriptions of subscription tiers and their general feature sets, if applicable, are available on the subscription sign-up page and related marketing materials. GoEducate reserves the right to modify, add, or remove features available at each tier at any time, and you acknowledge that not all features may be included in all tiers without prior notice.

4. Account Registration, Verification, and Security

To access certain features of the Platform, you must create an Organizational account. You agree to:

  • Provide accurate, current, and complete information during registration, including a valid Employer Identification Number (EIN). GoEducate reserves the right to verify your EIN and may deny or terminate access if verification standards are not met.
  • Maintain the security and confidentiality of your account credentials and promptly update any changes to your account information.
  • Notify GoEducate immediately of any unauthorized access to your account.

GoEducate shall not be liable for any loss or damage arising from unauthorized access due to inadequate security measures taken by the Organization. Employers bear full responsibility for all activities occurring under their account.

5. Subscription Plans, Fees, and Payment

Organizations may select from various subscription plans and optional add-ons. Your access to certain features depends on your chosen plan.

5.0 New Pricing Structure

Beginning on or after [TBD], GoEducate intends to offer three main subscription tiers:

  • Free – $0/month with limited features.
  • Recruitment – $350/month (or $3,780/year with a 10% discount).
  • Accelerate+ – $600/month (or $6,480/year with a 10% discount).

No Current Charges: During our [Beta/Preview] period, we do not charge subscription fees. We will provide at least 30 days’ notice before activating any paid plans.

GoEducate reserves the right to modify the fees and features associated with each plan. Your continued use of the Platform after any pricing adjustments constitutes acceptance of the new fees.

5.1 Fees and Billing

You agree to pay all fees associated with your selected plan. Payments are due according to the terms and prices displayed at sign-up, including any renewal terms. Except as required by law, all fees are nonrefundable. No partial or pro-rata refunds will be issued.

5.2 Limited-Time Promotions and Trials

1. GoEducate may, at its sole discretion, offer beta trials or other selective access programs to a limited number of Organizations for testing new features or exploring certain subscription tiers. During these beta trials, subscription fees may be waived, reduced, or otherwise adjusted to gather feedback and improve the Platform.

a. Selective Beta Invitations

  • GoEducate will notify qualifying Organizations about beta availability, including the nature of the features being tested, any special terms, and the duration of the beta.
  • Participation is optional, and once the beta ends, GoEducate will require Organizations to provide payment information or choose a paid subscription tier to retain premium features.

b. No Guarantee of Beta Access

  • Not all Organizations will be invited to beta trials. GoEducate selects participants based on factors like industry, region, or potential feature fit.

c. No Liability for Beta Changes

  • Features in beta may be modified, suspended, or discontinued at any time without notice. GoEducate disclaims liability for any losses or damages resulting from such changes.
5.3 Changes to Fees

GoEducate reserves the right to modify fees, pricing, or available plans. Material changes will be communicated in advance, and your continued use after notice of such changes constitutes acceptance of the new fees.

5.4 Feature Availability and Maintenance

You acknowledge and agree that certain paid features may, from time to time, become temporarily unavailable or experience technical issues due to maintenance, upgrades, or unforeseen technical difficulties. It is your responsibility to promptly notify GoEducate of any feature malfunctions, downtime, or issues with service delivery. Upon receiving notice, GoEducate will make commercially reasonable efforts to remediate the problem and restore the feature’s availability and functionality as soon as possible.

GoEducate disclaims liability for any loss of business, opportunities, or data resulting from temporary feature unavailability or technical limitations. No refunds, credits, or other financial remedies shall be provided for intermittent downtime or performance issues unless otherwise required by applicable law.

5.5 New Feature Releases and Modifications

GoEducate continually refines and improves the Platform and may roll out new features or enhancements to existing functionalities over time. Unless specifically stated as an advanced feature or subject to an additional fee, these new or upgraded features will be made available at no extra charge to your existing account.

  • Beta or Early Access Features
    Some features may be classified as “beta” or “early access,” meaning they can be subject to more frequent updates, potential downtime, or changes in functionality. By enabling or testing these features, you acknowledge they may not perform consistently or be available at all times.

GoEducate reserves the right, at its sole discretion, to introduce premium or advanced features that may incur additional costs, and will provide notice of such fees before you choose to enable or access those features. The inclusion of certain functionalities within your subscription plan at one point does not guarantee their indefinite availability. GoEducate may modify, update, suspend, or discontinue features at any time to maintain, enhance, or improve the overall Platform experience.

5.6 No Reliance on Oral Representations

All terms, conditions, and features available to you are as described in written documentation provided by GoEducate, whether within these Terms, posted on the Platform, or communicated via official GoEducate materials. Any oral statements or representations made by GoEducate personnel or third parties are not considered legally binding. You agree to rely solely on these written Terms and any official written materials to determine the scope and nature of the services provided.

Marketing & Written Materials

In the event of any conflict between marketing brochures, promotional emails, or statements made by GoEducate representatives and these Terms, these Terms (alongside official written policies) shall control. Features or pricing indicated in marketing materials are subject to revision, and continuing use of the Platform after any notice of changes constitutes acceptance.

6. Use of the Platform and Compliance with Laws

You agree to:

  • Use the Platform solely for lawful recruitment, workforce development, and related organizational purposes.
  • Comply with all applicable laws, including labor laws, anti-discrimination statutes, youth protection laws (e.g., COPPA), and data privacy regulations.
  • Ensure that your job postings and apprenticeship listings comply with all applicable laws and regulations. GoEducate does not verify postings for compliance and reserves the right to remove any listings deemed non-compliant, flagged by users, or otherwise inappropriate.
6.1 Background Checks and Screening

If your Organization conducts background checks, credit checks, drug screenings, or other forms of candidate evaluation using data obtained through the Platform or related leads, you are solely responsible for ensuring compliance with all applicable laws (e.g., the Fair Credit Reporting Act) and relevant regulations. GoEducate does not conduct or facilitate such checks and disclaims any liability arising from your screening practices.

6.2 Record-Keeping and Legal Compliance

Your Organization is responsible for maintaining any records, documentation, or data required by law or regulation, including but not limited to Equal Employment Opportunity (EEO) records, Office of Federal Contract Compliance Programs (OFCCP) data, or other applicable regulatory compliance materials. GoEducate does not maintain records on your behalf for legal compliance purposes beyond its standard retention policies.

7. Candidate Data and Privacy

Your use of candidate information obtained through the Platform must comply with the GoEducate Employer/Organization Privacy Policy, all applicable data protection laws, and these Terms. You must:

  • Respect candidate visibility preferences. If a candidate opts out of being visible or no longer appears in the Talent Hub, treat this as a revocation of consent to use previously accessed data.
  • Immediately cease contacting candidates who unsubscribe from communications or opt out of receiving further messages.
  • Handle information related to candidates under 18 with heightened care and in compliance with applicable laws. If you become aware of a candidate under 13 using the Platform without proper consent, notify GoEducate immediately and cease all engagement with that data.
  • Implement appropriate security measures to protect candidate data against unauthorized access. You are solely responsible for safeguarding candidate data obtained through the Platform.
  • Securely delete or otherwise cease using candidate data upon candidate request, expiration of the permitted usage period, or whenever retention of such data is no longer legally or contractually justified. This obligation extends to all candidate data scenarios.
  • No Unauthorized Sharing of Candidate Data: You shall not share, publish, sell, or otherwise distribute candidate data—including personally identifiable information and background details—obtained from the Platform to any third party not involved in the legitimate recruitment process for the position at issue. Unauthorized disclosure or dissemination of candidate data is strictly prohibited. If such nefarious data distribution is discovered (e.g., scraping of personal information or any form of unauthorized resale), the offending Organization or individual may be subject to legal action, including lawsuits for violations of privacy, contract breaches, and other applicable claims.

8. Communication with Candidates

You may communicate with candidates through GoEducate’s authorized messaging features for legitimate recruitment or career development purposes only. You agree to:

  • Immediately cease communications upon a candidate’s request, opt-out, or unsubscribe.
  • Not circumvent a candidate’s stated communication preferences by attempting to contact them through alternate means after they opt out.
8.1 Candidate Misconduct Reporting Mechanism

If you encounter inappropriate candidate behavior (e.g., harassment, fraudulent activity), you may report it through GoEducate’s dedicated reporting channel. GoEducate will investigate and may take corrective action, including warnings, suspension, or termination of the candidate’s account. However, GoEducate is not obligated to disclose the outcome of such investigations and disclaims liability for the actions or omissions of any candidate.

8.2 Inappropriate Conduct Toward Candidates

Organizations are strictly prohibited from engaging in threatening, harassing, discriminatory, sexually harassing, or otherwise inappropriate behavior toward candidates. This includes, but is not limited to, stalking, bullying, intimidation, exploitation of minors, or any conduct that violates applicable laws or human rights standards. If GoEducate becomes aware of such behavior:

  • Immediate Suspension or Termination: GoEducate reserves the right to immediately suspend or terminate the Organization’s account without prior notice. No refunds or compensation will be provided under these circumstances.
  • Reporting to Authorities: If the reported conduct suggests potential criminal activity (e.g., threats of violence, sexual misconduct, or harassment of minors), GoEducate may report the Organization and any relevant information, including account details and communications, to appropriate law enforcement or regulatory authorities.
  • No Liability for Enforcement Actions: By using the Platform, the Organization acknowledges and agrees that GoEducate shall not be liable for any claims or damages arising from suspension, termination, or referral to authorities resulting from the Organization’s inappropriate conduct.

9. No Guarantee of Hiring Outcomes & Neutral Facilitator Status

GoEducate does not guarantee that using the Platform will result in successful hires, apprenticeships, or internships. GoEducate serves solely as a neutral facilitator, providing tools, insights, and access to candidate information. All employment terms, hiring decisions, and workplace interactions are determined solely by you and the candidates. GoEducate does not endorse or manage the employment relationships formed through the Platform.

10. Third-Party Integrations, External Platforms, and Intellectual Property

GoEducate may integrate with third-party services or display third-party data to enhance your experience. Such integrations and data are provided “as is,” and GoEducate does not guarantee their accuracy, reliability, or availability. You use these integrations at your own risk and must comply with any applicable third-party terms.

If your job postings, profiles, or related data are shared with external job boards, workforce agencies, or other partner platforms, you acknowledge that GoEducate is not responsible for the policies, practices, or availability of these external entities. Any actions taken by those external platforms—including moderation, downtime, or removal of your listings—are outside GoEducate’s control, and GoEducate disclaims liability for any associated losses or damages.

10.1 Intellectual Property and Use Restrictions

All trademarks, service marks, logos, designs, text, graphics, and software incorporated into the Platform (“GoEducate IP”) are the exclusive property of GoEducate or its licensors. You receive a limited, non-exclusive, non-transferable license to access and use the Platform solely for the authorized purposes set forth in these Terms.

You shall not copy, reproduce, modify, distribute, transmit, publicly display, publicly perform, republish, download, store, or create derivative works of any GoEducate IP without the express written consent of GoEducate. Unauthorized use of GoEducate IP is strictly prohibited and may result in suspension or termination of your account and potential legal action.

11. Data Accuracy and Reliability

GoEducate strives to provide accurate and timely information, including candidate profiles, industry insights, and survey data. However, we do not warrant the completeness, accuracy, or reliability of such information. You are responsible for independently verifying key information before making hiring decisions.

12. Fraud Prevention, Security, and Employer Responsibility

You acknowledge that GoEducate provides services on an “as is” and “as available” basis. You must take all reasonable steps to secure your account and prevent fraudulent activity. While GoEducate implements security measures to protect data, no security measures are infallible. You acknowledge that unauthorized third parties may still attempt to circumvent these safeguards. GoEducate disclaims liability for any losses arising from fraudulent or unauthorized use of your account due to your security lapses.Employers attempting to exploit, manipulate, or misuse the Platform’s functionalities—such as submitting false information or unauthorized data harvesting—are in breach of these Terms. GoEducate may suspend, terminate, or take legal action against such Employers.

13. Maintenance, Updates, and Downtime Notices

GoEducate endeavors to maintain the Platform’s functionality and will, where practicable, provide advance notice of scheduled maintenance or planned updates that may temporarily impact feature availability. However, GoEducate does not guarantee uninterrupted access to the Platform, and routine maintenance or emergency repairs may occur without prior notice. You agree that GoEducate shall not be liable for any losses resulting from planned or unplanned maintenance periods.

14. Termination and Data Export

GoEducate may suspend or terminate your access to the Platform if you:

  • Violate these Terms or the Employer/Organization Privacy Policy.
  • Engage in unlawful, fraudulent, abusive, or harmful activity.
  • Fail to pay applicable fees when due.

Upon termination, you must discontinue use of the Platform and delete any candidate data obtained through it, except as may be required by law. No refunds will be issued upon termination.

If you wish to export any data you have provided to the Platform (e.g., job postings or analytics), you should do so before termination, if such export tools are available. GoEducate is under no obligation to provide data export services post-termination.

15. Limitation of Liability

To the fullest extent permitted by law, GoEducate and its affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, data loss, or business interruption, arising out of or related to these Terms or your use of the Platform. Under no circumstances shall GoEducate be required to provide any monetary remedy, reimbursement, or compensation for any claims, damages, or disputes. You acknowledge that you access and use the Platform at your own risk.

16. Disclaimer of Warranties

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. GoEducate does not guarantee uninterrupted or error-free operation of the Platform.

17. Indemnification

You agree to indemnify, defend, and hold harmless GoEducate, its affiliates, officers, directors, employees, agents, and assigns from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Platform.
  • Your violation of these Terms or applicable law.
  • Your postings, communications, or data handling practices, including any breaches of privacy, data security, or unauthorized use of candidate data.
  • Your infringement or misuse of intellectual property or proprietary rights.

18. Arbitration and Dispute Resolution

Any disputes arising from or related to these Terms or the Platform shall be resolved exclusively through binding arbitration under the American Arbitration Association (AAA) rules in Round Rock, Texas. By using the Platform, you waive the right to participate in class actions or other collective legal actions.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

20. Changes to Terms

GoEducate reserves the right to modify or update these Terms at any time. Material changes will be communicated via reasonable means, such as posting a revised version on the Platform or sending an email notification. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

21. Severability and Waiver

If any provision of these Terms is held invalid, illegal, or unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. Any waiver of a provision must be in writing and signed by an authorized representative of GoEducate. Failure to enforce any provision shall not constitute a waiver of that or any other provision.

22. Entire Agreement

These Terms, together with the Employer/Organization Privacy Policy, the GoEducate Consumer Privacy Policy, and any other referenced agreements or policies, constitute the entire agreement between you and GoEducate regarding your use of the Platform and supersede all prior negotiations, understandings, or agreements. You agree that no oral representations or promises not reflected in these written Terms and referenced documentation shall be binding.
